The Planning Group Ltd is fortunate to be regularly commissioned by clients who require assistance in procuring a Certificate of Proposed Lawful Development for residential work under the General Development Order (GDO) for work which is complicit to the complicated Permitted Development (PD) rules.  It always sounds simple when reading company’s sales pitch on their website  which state “No need for Planning Permission”, however we advise clients to beware, this is not always the case.

Most of the time what is allowed under PD is restrictive and the question is “will it give you what you really want?”  Many times the answer is no and Full Planning Consent is required.

We work regularly on garden rooms, single or double storey extensions and annexes for elderly relatives or the extended family.

Recent successes includes a linked extension to a non-designated heritage asset (formally a Chapel in the Shropshire countryside).

Together with the development of a two storey extension to provide living accommodation for elderly parents in Weston Rhyn which was initially refused by Shropshire Council.  We appealed the decision and the Planning Inspectorate allowed the appeal, appeal decision below:-

Plus an extension to, and conversion of the existing double garage to form live-in carers accommodation including associated hard paving to a property owned by an existing client with whom we worked for many years.  The original application was refused by Shropshire Council twice after us trying to work with them. This led to the client and ourselves agreeing we should appeal the decision and an excellent result flowed whereby the Planning Inspectorate allowed the proposal, appeal decision below:

We can advise if the work you propose to your home requires formal planning permission or if it can be undertaken as permitted development.  Even if a proposal falls under permitted development, we recommend, to prevent issues arising if you decide to sell your home in the future, that you seek a Certificate of Proposed Lawful Development/Use.

This will protect you from any delays or even loss of sale, while solicitors search for legal confirmation of any built changes/uses to your property.
